MarlyBird.com Terms of Use – YarnSports LLC

These Terms of Use (“Terms”) govern your access to and use of marlybird.com (the “Site”) and any related services, content, or products offered by YarnSports LLC, doing business as Marly Bird (“Company,” “we,” “our,” or “us”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
1. Access and Use of the Site
- License: Limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.
- Account Credentials: Required for certain features. Do not share login info. Sharing, sublicensing, or reselling is prohibited.
- Prohibited Conduct: Redistributing content without permission; reverse engineering or creating derivative works; violating laws or third-party rights.
2. Intellectual Property
All Site content (text, images, patterns, videos, tutorials) is owned by YarnSports LLC and protected under U.S. and international copyright laws. Unauthorized use may result in termination and legal action.
3. Privacy and Ad Tracking
Your use of the Site is subject to the YarnSports LLC / Marly Bird Privacy Policy, including:
- Raptive and Meta Pixel tracking
- PayPal and Stripe processing disclosures
- Behavioral advertising and opt-out rights
- Device/platform instructions

5. Binding Arbitration & Mass Claims
- Disputes resolved via binding arbitration in Indiana, using AAA arbitration provider
- Batch arbitration: only for 50+ similar claims in 30 days; arbitrator may consolidate/limit claims
- No class actions outside batch arbitration
- Small claims court and IP/injunctive relief exceptions remain
- Arbitration decisions are final and binding
6. Limitation of Liability
YarnSports LLC is not liable for indirect, incidental, consequential, or punitive damages, including loss of data, revenue, or profits.
7. Indemnification
You agree to indemnify, defend, and hold harmless YarnSports LLC, its affiliates, and officers, directors, employees, and agents from claims arising from use or violations of these Terms.
8. Children’s Privacy
The Site is not intended for children under 13. YarnSports LLC does not knowingly collect information from children under 13. Deletion requests: contact@marlybird.com.

10. Governing Law
Indiana law governs these Terms. Disputes resolved in Indiana courts unless subject to arbitration.
