1. Eligibility
- Open to participants aged 18 and older.
- Not open to individuals under 13. We do not knowingly collect personal information from minors under 13.
- Void where prohibited by law.
2. No Purchase Necessary
- Entry into the giveaway is free and does not require a purchase.
3. Data Collection and Sharing
- By entering, participants agree to provide email addresses and other optional information.
- Data may be shared with MarlyBird.com and the giveaway sponsor for administering the giveaway and marketing purposes.
- Information may be processed using Raptive, Meta Pixel, and payment processors such as PayPal or Stripe.
- By entering, participants consent to this collection, sharing, and marketing use.

4. Winner Selection
- Winners are selected at random and notified via the email provided.
- Odds of winning depend on the number of entries received.
- Winner selection is final and binding.
5. Data Retention
- Collected personal information will be retained only as long as necessary to administer the giveaway and comply with legal obligations.
- Afterwards, data will be securely deleted or anonymized.
6. Privacy Rights
Participants may exercise their rights under CCPA, GDPR, and other applicable privacy laws:
- Right to Know: What data is collected and how it is used
- Right to Delete: Request deletion of personal data
- Right to Opt-Out: Prevent sharing or “sale” of personal data to third parties
- Authorized Agents: Participants may designate an agent to submit requests with written permission or proof of authority

7. Wiretapping / Consent
- All data collection methods, including Meta Pixel and Raptive tracking, comply with applicable wiretapping and electronic communications laws.
- By entering, participants consent to data collection and sharing as described.
8. Liability Release and Responsibility
- MarlyBird.com and the giveaway sponsor are not responsible for technical errors, failures, or interruptions that may affect entry.
- By entering, participants release and hold harmless MarlyBird.com and the sponsor from any claims, damages, losses, or expenses arising from participation or prize acceptance.
9. Arbitration and Dispute Resolution
- Participants agree to resolve any disputes individually via binding arbitration in Indiana, using AAA arbitration provider.
- Batch arbitration applies only for 50+ substantially similar claims in 30 days; the arbitrator may consolidate or limit claims.
- No class actions outside batch arbitration.
- Small claims court and IP/injunctive relief exceptions remain.
10. California and U.S. Compliance
- CCPA Compliance: This giveaway complies with the California Consumer Privacy Act. Participants will not be discriminated against for exercising CCPA rights.
- Wiretapping / Consent: By entering, you provide consent for data collection as described.
11. General Legal Notes
- Giveaway governed by Indiana law.
- MarlyBird.com and sponsor reserve the right to modify or cancel the giveaway at any time.
- Participants waive the right to participate in a class-action lawsuit.
- Giveaway void where prohibited.
